These Terms govern access to and use of SetupLab Pro, a web application (SaaS) for motorsport setup engineering. By registering an account, starting a trial or purchasing a subscription, the customer accepts these Terms in full. If you do not agree, do not use the Service.
The Service is intended for companies and professionals (B2B use). The customer represents that they are acting in the course of their business or professional activity.
2.1. Using the Service requires creating an account with a valid email and a password. The customer is responsible for keeping their credentials confidential and for all activity under their account.
2.2. The customer must provide accurate information and keep it up to date. Rbs racing may suspend or terminate accounts with false data or uses that breach these Terms.
2.3. Accounts are organized into teams. The team owner may invite other users ("seats") up to the number of seats purchased.
3.1. The Service is offered on a per-seat (per-user) monthly paid subscription, with monthly or annual billing. Current prices are shown on the website and apply at the time of purchase.
3.2. Prices are shown excluding tax. Applicable taxes (VAT, sales tax or others) are calculated and added at checkout based on the customer's country and tax status. EU business customers with a valid intra-community VAT number may benefit from the reverse-charge mechanism.
3.3. A subscription grants a set number of seats. Once the limit is reached, no new users can be added without upgrading the plan.
3.4. Rbs racing may change prices. Changes do not affect the period already paid and will be communicated with reasonable notice before the next renewal.
4.1. The Service may offer a 14-day trial. To start the trial, the customer must provide a valid payment method.
4.2. Unless cancelled before the end of the trial, the subscription will start automatically and the first period will be charged at the end of the 14 days. The customer may cancel at any time before that date at no cost.
4.3. The subscription renews automatically at the end of each period (monthly or annual) at the then-current price, until cancelled. Cancellation takes effect at the end of the period already paid; there is no further renewal.
4.4. Cancellation and refund conditions are detailed in the Cancellation and Refund Policy.
5.1. Payments, billing and collection are handled by our provider Paddle (Paddle.com Market Ltd) as Merchant of Record (authorized reseller). This means Paddle acts as reseller of the Service for the transaction and is responsible for collection and tax handling.
5.2. The purchase invoice is issued by Paddle, and Paddle's terms and privacy policy also apply to the payment process.
5.3. The customer manages their payment method, invoices and cancellation through the Paddle customer portal, accessible via links provided by the Service or by Paddle.
The customer agrees not to: (a) resell, sublicense or transfer access without authorization; (b) reverse engineer, decompile or extract the code or logic of the Service; (c) use the Service for unlawful purposes or in violation of third-party rights; (d) attempt to access other teams' data or compromise the Service's security; (e) overload the infrastructure through abusive automated use.
7.1. SetupLab Pro and Rbs autocode are proprietary software of Rbs racing, S.L. The application, its source code, architecture, vehicle-dynamics logic, interface, documentation, reports and generated materials are protected by intellectual property rights.
7.2. The subscription grants a limited, non-exclusive, non-transferable and revocable right of use for its duration. It grants no ownership, source-code access, resale rights or reverse-engineering rights.
7.3. Customer data: the data the customer enters (cars, sessions, setups, notes) belongs to the customer. Rbs racing processes it solely to provide the Service, in accordance with the Privacy Policy.
8.1. The Service includes an engineering assistant that may rely on third-party artificial-intelligence models (e.g., OpenAI). Problem descriptions the customer submits to the assistant may be processed through such providers to generate the response.
8.2. All setup values, recommendations and engineering outputs are provided as decision-support information. They guarantee no result. Their use in competition requires professional validation by the responsible engineer. The customer is solely responsible for the technical and safety decisions they make.
9.1. Rbs racing will make reasonable efforts to keep the Service available but does not guarantee uninterrupted or error-free operation. Interruptions may occur due to maintenance, technical causes or third-party providers.
9.2. Support is provided by email at hola@rbsautocode.com.
10.1. To the maximum extent permitted by law, the Service is provided "as is" and "as available".
10.2. Rbs racing is not liable for indirect damages, loss of profit, loss of data or damages arising from technical or sporting decisions made based on the Service's information.
10.3. Rbs racing's total aggregate liability to the customer is limited, where applicable, to the amount actually paid by the customer for the Service in the 12 months preceding the event giving rise to the claim.
11.1. Rbs racing may suspend or terminate access in the event of non-payment, breaches of these Terms or uses that put the Service or third parties at risk.
11.2. The customer may stop using the Service and cancel their subscription at any time (see Cancellation Policy).
11.3. After termination, access ceases at the end of the paid period. Customer data may be retained for a limited period and then deleted, in accordance with the Privacy Policy.
Rbs racing may update these Terms. Material changes will be communicated with reasonable notice. Continued use after they take effect constitutes acceptance.
13.1. These Terms are governed by Spanish law.
13.2. For customers acting as businesses or professionals, the parties submit to the Courts of Castellón (Spain), waiving any other jurisdiction. This is without prejudice to any mandatory protective rules that may apply to customers in their capacity as consumers in their country of residence.
